Consultations, bookings and commitments
Purpose
These terms set out the conditions under which Karl Stephane’s private consultations are offered and govern the relationship between Karl Stephane, his concierge service and anyone requesting a consultation.
A consultation is a personal service based on perception, intuition, experience and Karl Stephane’s own approach.
It is neither an exact science nor a contractual promise that any future event will occur. No prediction may be regarded as a guarantee of results.
Clients remain free at all times to make their own choices and decisions and to determine how they use anything discussed during a consultation.
A personal, human and independent consultation
All consultations offered by Karl Stephane are conducted personally by him.
No artificial intelligence, automated system, conversational agent or algorithmic generation process replaces Karl Stephane in his perceptions, interpretations, answers or consultations.
Any technical tools used to operate or administer the website, provide administrative support, present its content or facilitate certain communications are not themselves part of the consultation.
The substance of every consultation with Karl Stephane remains personal and human.
Access to consultations
Consultations are available on request and subject to availability.
Given the high demand for Karl Stephane’s services, the concierge service cannot guarantee an appointment on any particular date.
Where demand is high or a situation calls for a reasonably prompt response, the concierge service will nevertheless do its best to find a suitable option.
In the field of clairvoyance, however, urgency must never be confused with a medical, legal, psychiatric or personal-safety emergency.
It may, moreover, be preferable not to arrange a consultation immediately while experiencing particularly intense emotions, in order to retain the perspective needed for a meaningful exchange.
Appointment requests
Requests for consultations are received in particular through the website’s official channels, its contact form or Karl’s Concierge chat.
To process a request, the concierge service may ask for the client’s name, telephone number, email address and a message explaining the nature of the enquiry.
This information is used solely to process the request, arrange the appointment and, where applicable, manage the resulting administrative relationship.
An enquiry sent to the concierge service does not in itself constitute definitive confirmation of an appointment.
An appointment becomes effective only once it has been expressly confirmed in accordance with the arrangements communicated by the concierge service.
Fees and payment
The applicable fees are those communicated to the client before their booking is definitively confirmed.
Prices are expressed in euros. Clients are informed of the service price before making a commitment.
Subsequent changes in fees do not affect a consultation already definitively booked and paid for at the previously agreed price, unless the parties agree otherwise.
Payment arrangements are specified at the time of booking.
Depending on the service selected, payment may be requested before the consultation or under other arrangements expressly agreed upon.
Where advance payment is required, confirmation of a booking may be conditional upon actual receipt of that payment.
All payments must be made through the methods officially communicated by the concierge service.
Karl Stephane cannot be held responsible for payments which a client voluntarily sends to an account, individual, website or intermediary outside his official channels.
Rescheduling, cancellation and non-attendance
A confirmed appointment may be rescheduled up to 24 hours before the scheduled consultation time, subject to availability.
Requests to reschedule must be sent to the concierge service as soon as possible. An alternative will be considered in light of Karl Stephane’s diary.
Rescheduling changes the appointment time; it does not constitute cancellation of the service.
Once the 24-hour deadline has passed, the booked consultation remains payable, unless the concierge service makes an exceptional decision or mandatory legal provisions require otherwise.
Given the time specifically reserved in Karl Stephane’s diary and the high demand for consultations, a confirmed booking commits the client in accordance with the conditions communicated when the appointment was made.
If the client fails to attend, cannot be contacted for the appointment or cancels less than 24 hours before the consultation, the service remains payable.
Any flexibility granted in an individual case does not permanently amend these terms and creates no entitlement in respect of subsequent consultations.
If Karl Stephane is exceptionally unable to conduct a confirmed appointment, the concierge service will offer rescheduling as its first option.
Where rescheduling is impossible or clearly unsuitable, any sums received for a service not provided will be dealt with in accordance with applicable regulations.
Lateness
To respect the appointments of subsequent clients, a client’s late arrival cannot normally result in an equivalent extension to the scheduled end time.
If the consultation can nevertheless go ahead, it may end at the time originally scheduled.
Significant lateness may be treated as non-attendance where it makes the normal conduct of the appointment materially impossible.
Right of withdrawal
Confirming a booking constitutes a firm commitment by the client under these general terms.
When a consultation is scheduled before the statutory withdrawal period applicable to distance contracts has expired, the client expressly requests that the service begin before the end of that period.
By definitively confirming a booking using the designated process, the client acknowledges having requested early performance of the service and having been informed that the right of withdrawal will be lost once the consultation has been fully performed.
How a consultation is conducted
Karl Stephane conducts each consultation freely, guided by the perceptions, information and questions that arise during the exchange.
Clients are encouraged to take part in the consultation openly and sincerely.
Karl Stephane remains free to say that he cannot perceive anything sufficiently clear about a question rather than offer an artificial or merely pleasing answer.
The length of a consultation may vary depending on the service chosen and the nature of the exchange.
A stated duration indicates the time normally allocated to an appointment; it does not require any predetermined number of predictions, answers or topics.
No guarantee of results
Clairvoyance is, by its nature, an interpretive practice.
Information shared during a consultation reflects Karl Stephane’s perceptions at the time of the exchange.
It does not guarantee that the events discussed will occur exactly as described or within any time frame that may have been suggested.
Whether to follow, disregard or interpret something communicated during the consultation in a particular way is entirely the client’s decision.
Free will and client responsibility
A consultation is intended to offer a perspective, perception or insight. It is not intended to make decisions on the client’s behalf.
Karl Stephane encourages everyone to retain their free will, critical judgment and personal responsibility.
Any romantic, family, professional, financial, property-related or personal decisions made after a consultation remain the responsibility of the client.
Health, law, finance and emergencies
A clairvoyance consultation is never a substitute for the services of a qualified professional.
In particular, Karl Stephane does not provide medical diagnoses, prescriptions, personalised legal advice, investment recommendations, or psychological or psychiatric care.
If a situation involves medical care, mental health, the law, emergency assistance, someone’s safety, or a serious and immediate risk, the client must contact the appropriate professionals or emergency services.
Karl Stephane may decline to answer a question if he considers it to fall outside the reasonable and responsible scope of his work.
Death, mediumship and sensitive subjects
Karl Stephane reserves the right, in a clairvoyance consultation, not to address certain requests, particularly those concerning serious illness, death, a missing person, ongoing legal proceedings, violence, danger, or any subject whose nature calls for the involvement of a specialised professional.
Mediumship is a separate service, discussed beforehand; it is never improvised during a clairvoyance consultation.
A consultation may also be interrupted if an exchange becomes manifestly incompatible with its purpose, disrespectful, threatening, abusive or liable to endanger anyone.
Confidentiality
Confidentiality is an integral part of Karl Stephane’s approach.
Information shared during a consultation is handled discreetly.
The fact that some people who are known to the public may consult Karl Stephane does not give rise to any public communication by him without their consent.
No one may demand disclosure of another client’s identity, the content of their consultation or details of their private life.
Confidentiality is, of course, subject to any legal obligations that may apply to a professional.
Testimonials, personal data and confidentiality
Testimonials published on the website
Clients who wish to share their experience may send a testimonial to the concierge service.
With their consent, it may be published under their first name, an identity they have authorised for publication, or anonymously if they do not wish to be identifiable.
No private testimonial is published without permission.
The concierge service may make spelling or typographical corrections, provided these do not alter the meaning of the testimonial.
Karl Stephane reserves the right not to publish a message, particularly where it contains information about third parties, allegations, personal data or content unrelated to the consultation.
Reviews published on third-party platforms
Reviews published on Google, social networks, forums or any other independent platform are subject to the rules of those services.
Karl Stephane does not systematically verify the identity of their authors or whether a consultation actually took place in relation to each post.
A review on a third-party platform must therefore not automatically be regarded as a testimonial verified by the concierge service.
Anyone wishing to share their experience directly may write to the concierge service so that, if they wish, it can be retained or published under the conditions described above.
Personal data
In operating the website and processing enquiries, information collected may include names, telephone numbers, email addresses, the contents of messages, details required for a booking, and certain technical data necessary for the website to function.
Data that is not reasonably necessary to process a request is not intended to be collected systematically.
The information collected may be used, in particular, to reply to enquiries sent to the concierge service, arrange and follow up on appointments, communicate with clients, fulfil administrative or accounting obligations, prevent abuse or fraudulent use, and ensure the website’s technical operation and security.
This information is not intended to be sold to third parties as commercial contact lists.
Data is retained for a period appropriate to its purpose and to applicable legal obligations.
Information that is no longer needed is intended to be deleted, anonymised or archived where retention is required by law.
Certain administrative or accounting records may therefore be kept longer than ordinary messages sent to the concierge service.
Individual rights
In accordance with applicable data-protection rules, individuals may, depending on their circumstances and the lawful basis for processing, exercise rights including access, rectification, erasure, restriction of processing and objection.
Requests concerning personal data may be sent to conciergerie@voyancekarlstephane.com.
The applicant’s identity may be checked where necessary to prevent a third party from fraudulently accessing information that does not concern them.
Anyone who believes, after contacting the data controller, that their rights have not been respected may also lodge a complaint with the CNIL, the French data-protection authority.
Technical service providers
Certain data may technically pass through providers needed to operate the website, email, contact form, chat, appointment booking or payment systems.
These providers are subject to the confidentiality obligations applicable to their services.
The use of these tools is limited to what is needed to provide the service.
Cookies
The website may use cookies or comparable technologies strictly necessary for its operation and, where applicable, audience-measurement tools or third-party services.
Where regulations require prior consent, the relevant cookies must not be placed until the user has made a choice.
Users may change their preferences using the options provided by the cookie-management mechanism available on the website.
Intellectual property, artificial intelligence and identity
Protection of content
Unless otherwise stated, all content available on voyancekarlstephane.com is protected.
This includes, in particular, texts, articles, photographs, portraits, videos, recordings, logos, distinctive signs, titles, graphics, presentations, layouts, taglines, Journal content and original creations.
Any reproduction or use outside the exceptions provided for by law requires the prior authorisation of the relevant rights holder.
The fact that content is freely accessible online does not mean that it is free of copyright or other rights.
Copying, plagiarism and reproduction
Unauthorised reproduction of all or a substantial part of the website’s content is prohibited where it infringes the rights of the relevant holder.
The same applies to adaptations, republications, translations and incorporation into another website, social-media account, book, commercial content or communication medium where these exceed uses permitted by law.
Karl Stephane attaches particular importance to protecting the editorial identity developed around his professional activity.
Repeated copying of characteristic wording, original compositions, graphic elements or a coherent combination of choices intended to recreate his universe may be assessed under applicable law, particularly where it is likely to cause confusion or take unfair advantage of the work and investment involved.
A general idea, aesthetic trend or isolated style cannot, of course, be claimed as anyone’s exclusive property.
This clause concerns protected creations and conduct that may give rise to legal remedies.
Imitation of Karl Stephane’s universe
The mere existence of a competing activity or comparable aesthetic universe does not, in itself, infringe Karl Stephane’s rights.
However, systematic exploitation of protected content, reproduction of original creations, copying of a collection of characteristic elements or any practice intended to cause deliberate confusion with his activity may be subject to appropriate action.
This includes situations where a third party seeks to impersonate Karl Stephane, present themselves as his representative or as an official service, or exploit his identity or reputation without authorisation.
Official channels, fake profiles and impersonation
Only the accounts, contact details and services directly listed on www.voyancekarlstephane.com should be regarded as official channels when presented as such.
Karl Stephane does not conduct unsolicited approaches from anonymous accounts, fake profiles or websites that are not listed on his official website.
The concierge service may, of course, contact someone again if that person has requested an appointment or submitted an enquiry through an official channel.
Such legitimate follow-up communication must not be confused with fraudulent solicitation.
Any unauthorised use of Karl Stephane’s name, photograph, identity or content intended to mislead the public may be reported and, where warranted, result in appropriate legal proceedings.
Subject to any liability imposed by law, Karl Stephane cannot be held responsible for money, information or data that a visitor voluntarily provides to a third party after being deceived by a fake account.
If in doubt, visitors are encouraged to verify the information directly with the concierge service.
Respect, complaints and final provisions
Mutual respect
A consultation requires a respectful exchange.
Insulting, discriminatory, threatening, sexually inappropriate, harassing or manifestly aggressive conduct may result in the immediate termination of the exchange.
The service may also be refused where someone’s behaviour makes it impossible to conduct the consultation under normal conditions.
Excessive use of consultations
Consultations should not become a source of dependency.
Karl Stephane may advise a client to space out appointments if he feels that their frequency is no longer beneficial or risks encouraging the person to seek continuous external validation before making any decision.
The purpose of a consultation is to offer insight, not to take away the client’s ability to decide for themselves.
Complaints
Should a difficulty arise in connection with a service, clients are encouraged to contact the concierge service first to seek an amicable solution.
Complaints may be sent to conciergerie@voyancekarlstephane.com.
They must contain sufficient information to identify the consultation concerned and explain the nature of the request.
Consumer mediation
In accordance with the applicable provisions of the French Consumer Code, consumers may use a consumer mediator free of charge to seek an amicable resolution of a dispute with the professional, provided they have first attempted to resolve the complaint directly with the professional.
Applicable law
These legal notices and terms are governed by French law, without prejudice to any mandatory provisions that may apply to consumers due to their place of residence.
In the event of a disagreement, the parties are encouraged to seek an amicable solution first.
Failing that, the dispute may be referred to the competent courts under the conditions laid down by law.
Nothing in these terms is intended to deprive a consumer of any mandatory right granted under applicable legislation.
Changes to these terms
Karl Stephane may amend this information to reflect changes in the operation of the website, his services or applicable regulations.
The applicable version is the version published on the website on the date the page is consulted, subject to any contractual conditions already definitively agreed with a client.
